1010 1022 Massachusetts Ave, Roxbury, Ma, 02118Dear Commissioner Del Rio, The Red Cross donation bins at Back Bay Station Clarendon - 145 Dartmouth appear unlicensed and in violation of Boston Municipal Code §9−9.8, which prohibits bins creating hazards and requires screening from residential view. They sit directly by residents' windows and have caused documented safety incidents. If ISD lacks jurisdiction over this matter, we urgently request that you forward this complaint to the proper agency instead of closing the ticket.

1010 1022 Massachusetts Ave, Roxbury, Ma, 02118Att: Commissioner Del Rio - ISD: Urgent Public Safety Hazard – Request Removal of Red Cross Donation Bins, Back Bay Station (145 Dartmouth/Clarendon, MBTA Property) We request the immediate removal of two Red Cross donation bins recently placed on MBTA property at 145 Dartmouth/Clarendon, pursuant to Boston Municipal Code §9-9.8. The bins are already in decay (broken hinges, graffiti, unserviced since 9/16) and have become a source of repeated hazards: drug use and discarded needles, theft and trading of donations for drugs, sex paraphernalia, vandalism, loud banging doors, loitering with needles near an emergency exit where there are senior citizens, and vehicles illegally blocking the MBTA bus loop. Police have been called multiple times. No registration certificates are posted, making the bins unlawful under §9-9.8. Their unscreened placement also violates §9-9.8(E), as they are in direct view of senior residents’ windows and obstruct safe egress and they do not appear to be approved by the MBTA (DOT). These bins are unlawful, unsafe, and a public nuisance. ISD has clear statutory authority and obligation under §9-9.8 to require removal |
