FORMAL COMPLAINT – REPEATED MUNICIPAL ORDINANCE VIOLATIONS, PUBLIC SAFETY HAZARDS, AND POTENTIAL LICENSING VIOLATIONS AT ALEX’S PIZZA Date of Incident: Saturday, October 17, 2026 Time: 2:37 AM – At least 3:20 AM Location: Alex’s Pizza, South End, Boston, Massachusetts Police Response: 911 called at approximately 2:37 AM; Boston Police responded. Evidence Available: Timestamped photographs and video recordings, available upon request. Incident Description At approximately 2:37 AM on Saturday, October 17, 2026, I was abruptly awakened inside my residence by two vehicles simultaneously sounding loud alarms directly outside Alex’s Pizza. Upon observing the street, I counted at least 12 vehicles illegally parked or stopped in designated bus and bicycle lanes. Approximately 30 to 40 individuals were congregating outside Alex’s Pizza and in the surrounding streets, contributing to the late-night disturbance. The illegally parked vehicles were obstructing designated bus and bicycle lanes and interfering with the normal flow of traffic. As documented in my photographs and video recordings, the obstructions forced passing motorists to maneuver into lanes intended for oncoming traffic, creating serious public safety hazards and increasing the risk of collisions involving motorists, cyclists, and pedestrians. The excessive vehicle noise and associated street activity occurred during overnight hours in a residential neighborhood, significantly disrupting my sleep and peaceful enjoyment of my home. Emergency Police Intervention and Immediate Recurrence Due to the severity of the disturbance, illegal parking, and dangerous roadway conditions, I contacted 911 at approximately 2:37 AM. Boston Police officers subsequently arrived and instructed individuals to move the illegally parked vehicles and stop the excessive vehicle horn or alarm noise. However, within approximately one minute of police intervention, several vehicles returned to the restricted bus and bicycle lanes and resumed illegally parking or stopping. This immediate recurrence is particularly concerning because the same unlawful roadway conditions reappeared almost immediately following direct police intervention. The incident raises serious concerns about the effectiveness of existing enforcement measures and the continued disregard for traffic restrictions and public safety. Continued Business Activity After 3:00 AM At approximately 3:20 AM, individuals remained visibly present inside Alex’s Pizza, while at least three vehicles remained illegally parked outside the establishment. I have photographic and video evidence documenting activity at the establishment and the surrounding roadway conditions during this period. The continued presence of individuals inside the establishment raises concerns regarding compliance with its approved operating hours and applicable Boston Licensing Board conditions. I request that the Boston Licensing Board verify the establishment’s authorized closing time, permitted food service hours, and any applicable conditions governing customer presence on the premises after closing. If the establishment was operating beyond its approved hours, I request appropriate investigation and enforcement. Potential Boston Municipal Ordinance Violations The documented conditions warrant investigation under the following provisions of the Boston Municipal Code and other applicable regulations. 1. Boston Municipal Code § 16-26.1 – Unreasonable or Excessive Noise Boston’s noise ordinance regulates unreasonable or excessive noise, including nighttime noise exceeding applicable limits. The ordinance establishes a general nighttime limit of 50 dBA between 11:00 PM and 7:00 AM, subject to its measurement rules and exceptions. The simultaneous vehicle alarms at approximately 2:37 AM were sufficiently disruptive to awaken me inside my residence. I request an investigation into potential violations of the City’s nighttime noise ordinance.
