Dear Inspectional Services Housing Division, I am writing on behalf of the 72–80 Fort Avenue Condominium Trust to request an inspection of our property at 72–80 Fort Avenue, Boston, MA 02119, to determine whether storing the required City trash and recycling bins on our property would violate egress requirements or other applicable housing or health codes due to the physical limitations of the site. Our five-unit residential building has extremely limited outdoor space, and there is no practical location to store the required trash and recycling bins without significantly obstructing access. The Office of Councilor Miniard Culpepper advised us to request an Inspectional Services Department Housing Division assessment as the first step in determining whether our property qualifies for a variance based on these site constraints. I have attached a photograph showing the current location of the bins and the available space. There is approximately 20 feet between the current location of the trash bins and where vehicles are parked, and the trash and recycling bins collectively occupy approximately 12 feet by 2 feet. The only available locations on our property where the bins could be relocated are the sidewalks and walkways that residents use to access their units. Given the limited dimensions of the property, we are concerned that placing the bins in these areas would obstruct the required means of egress, reduce safe pedestrian access, and create safety concerns for residents, visitors, and emergency responders. We would appreciate an inspection to determine: 1. Whether there is a code-compliant location on the property for storing the required trash and recycling bins; 2. Whether storing the bins on the property would violate egress requirements or other applicable housing or health regulations; and 3. Whether the property's physical limitations support a variance or other accommodation. If possible, we would appreciate a site visit so that we can walk the inspector through the property and explain the constraints firsthand. Thank you for your time and assistance.
