Case Resolved. Unfortunately, the Commonwealth of Massachusetts does not allow municipalities to regulate commercia trash pickup hours in designated commercial zones (Massachusetts General Laws Title XVI, Chapter 111, Section 31A: “...no rules or regulations shall restrict the hours of the day when garbage, offal or other offensive substances may be collected in areas zoned for business, commercial or industrial use.”) which prevents direct response in this case. Residential trash collection hours start at 6am and are governed by Boston Public Works Department. Thus, BPHC is unable to address this complaint.
