- $500 Moving Policy Violation Fee, Unit 717, 147 Kelton Street Charge disputed: $500 fee for violation of the Kelton Place Condominium Association Moving and Delivery Policy, posted to the owner's ledger following the August 2026 move-out of tenants Yi Xie and Yingzhen Jia. Basis of dispute: The fee was assessed for failure to schedule a move in accordance with association policy. No schedulable move occurred. The tenants moved only personal luggage and boxes, by hand, over the course of several days. No moving company was retained, no furniture or oversized items were transported, and at no time was the elevator held, reserved, or used exclusively. The tenants disclosed their move plan in writing on August 12, 2026, stating that scheduled elevator service was not required. Management responded the same morning asking whether furniture would be moved out. The tenants confirmed in writing, also on August 12, that no large furniture would be moved and that no specific moving window would be used. The tenants further submitted the move request form indicating that no scheduled window was needed. Following that exchange, management did not advise the tenants that a scheduled window, padded elevator, or certificate of insurance remained required in the absence of a furniture move. The tenants proceeded in reliance on management's silence following their written confirmation. No damage to the elevator or common areas has been identified, documented, or attributed to the tenants. Relief requested: Identification of the specific policy provision violated and the factual basis for the determination. Documentation of any damage attributed to the tenants, including date, description, and supporting evidence. Reversal of the $500 violation fee.
