- A large white box truck is regularly parked in an unimproved rear yard at 44 Newbern Street (fronting Everett Street), with no driveway, curb cut, or established parking space. See Boston Code Ordinance § 16-46.3(B). The truck is driven on and off the property from Everett Street over the public curb and sidewalk, where there is no curb cut. See Boston Public Works, Residential/Commercial Curb Cut Application Requirements & Guidelines for Issuance of a Curb Cut Permit. The weight of the vehicle creates a risk of damage to the curb; its traversal of the public sidewalk, including at night, creates a potential pedestrian hazard. Several arborvitae were removed to create the vehicle-width opening. Orange traffic cones are regularly placed near the opening, apparently to discourage lawful public parking and preserve vehicle access. The rear yard also contains empty boxes, felled timber, and other debris. These conditions present potential risks to pedestrian safety and the integrity of the public way and appear to involve multiple code and permitting violations.
