Resolved. All public street trees in the City of Boston and Massachusetts are protected by state law (MGL CH 87). The BPRD Urban Forestry Division is unable to remove a live and healthy public shade tree for the reason requested. The only way this tree could be removed for the reason requested is if the Public Works Department was planning to reconstruct all of Fletcher Street to make the sidewalks ADA compliant and to have public tree hearings for the possible removal of each shade tree on the street that is interfering with sidewalk passage. You can contact the City Clerks office regarding any damages to your property. Any repairs can be completed by you and any tree roots impacting your property my be cut at the property line.

Description
A large street tree at the border between 102 and 106 Fletcher in Roslindale has massively uplifted the sidewalk more than one foot causing a significant public safety hazard. The uplifted sidewalk has now heavily damaged a masonry wall and pulled apart a wrought iron fence atop it. There is thousands of dollars of damage to private property. My neighbor and myself have filed complaints with the city no less than three times over the past several years. Each time, a city crew adds more asphalt to the growing ramp - no real solution. There is now major private property damage. We now request a formal meeting with the city to fix the sidewalk buckling problem without taking down the tree as well as seeking compensation to fix the stone wall and metal fence.
