    MBTA Public Engagement: Back Bay Station ~ ADA, Public Health and Safety During the Boston Marathon period, international travelers are exposed to ongoing ADA access and public health hazards that have persisted for over one year. A consistent daily pattern (approx. 5:30–7:30 AM and 9:00–11:00 PM) involves the same individual sheltering in the station ~4 hours per day, including occupying the women’s restroom and blocking an ADA-accessible stall, as well as remaining in the commuter rail lobby. Observed conditions: standing water, unsanitary use with apparent human waste, and the individual using plastic materials as makeshift covering, often agitated and vocally distressed—creating biohazard exposure, slip/fall risk, and denial of ADA-compliant access. Station inspection personnel have reported this to the OCC, with Transit Police responses, yet the issue persists despite repeated reports and documented awareness. This raises concerns regarding compliance with the Americans with Disabilities Act (ADA), public health standards, and foreseeable liability.
