This particular manhole cover is a ongoing Public Nuisance to the area of 541, 540 and 556 Columbia Road. Due to the fact this eversource manhole cover is raised from the street, every time a large empty capacity dump truck, Little dump truck, any vehicle that has empty trailers or trailers attached hit this raised eversource manhole cover the noise that radiates has been extremely loud and disturbing. It is constant it is causing extreme Public Health and great diminishment of Quality of Life in the area. There are multiple people who suffer from PTSD, including but not limited to An AMERICAN VETERAN, myself and others. There has been multiple 311 complaints submitted on this issue and multiple complaints/tickets submitted to eversource to rectify this issue. 145 Dartmouth St, Boston, Ma, 02116Att Public Engagement Back Bay Station, on a nightly basis, between 9:00–10:00 PM, an individual occupies the ADA stall and engages in bathing activities for extended periods (often over an hour) and water is frequently splashed onto the restroom floor, and personal belongings, including a suitcase, obstruct access to the area. Following this, from 10:00–11:00 PM, the same individual stands near commuter rail ticket counter and wraps her body with plastic materials. This has been occurring for approximately one year and presents several concerns: ADA-designated stall is consistently unavailable for its intended use Water on the floor creates a slip hazard Sanitation and hygiene conditions are compromised Access is obstructed for individuals who require ADA accommodations Activity in common areas raises additional public health and safety concerns Given the duration and impact of this issue, intervention from MBTA management is requested, including coordination with public health services and ADA compliance personnel, to address the situation. | Case (SR) Type: [MBTA] Referred To: [MBTA]

City of Boston Ordinance 11-6.18 Indemnity for City. Every owner of an estate hereafter maintaining any cellar, vault, coal hole or other excavation under the part of the street which is adjacent to, or part of, his or her estate, shall do so only on condition that such maintenance shall be considered as an agreement on his or her part to hold the city harmless from any claims for damage to himself or herself or the occupants of such estate resulting from gas, sewage or water leaking into such excavation or upon such estate; and every such owner and every person maintaining a post, pole or other structure in a street, or a wire, pipe, conduit or other structure under a street, shall do so only on condition that such maintenance shall be considered as an agreement on his or her part with the city to keep the same and the covers thereof in good repair and condition at all times during his or her ownership and to indemnify and save harmless the city against any and all damages, costs, expenses or compensation which it may sustain or be required to pay, by reason of such excavation or structure being under or in the street, or being out of repair during his or her ownership, or by reason of any cover of the same being out of repair or unfastened during his or her ownership. Broken sidewalk. The owners of this building are aware that they are responsible for repairs. This sidewalk has been broken for years and is only getting worse. How long is the city going to wait before some enforcement action?
