    Subject: RECURRING ISSUE UPDATE: Back Bay Station ADA Restroom Access and Station Conditions . To: Mr. Phillip Eng and Mr. Angel Rodriguez-Donahue . This is a continuing concern previously reported on multiple occasions. Recent statements indicating that the individual is no longer present at Back Bay Station do not appear consistent with current on-site observations. For over a year, there has been a recurring pattern of prolonged presence within the station during early morning and late evening hours, including extended occupancy of the ADA-accessible restroom and extended stays in the commuter rail lobby. At times, associated activity within the immediate area has impacted passenger use of nearby seating and common spaces. There are also ongoing concerns regarding restroom cleanliness associated with this extended occupancy. A weekend MBTA inspector recently observed these conditions and notified Operations Control (OCC), including Transit Police notification. Clarification is requested regarding: • ADA restroom occupancy management • Sanitation response protocols • Response to repeated extended presence in station areas • Passenger seating and common area access • Monitoring and response consistency at Back Bay Station The concern remains focused on maintaining accessible restroom facilities, sanitation standards, and a safe, predictable environment for station users.
