Subject Back Bay Station – Restroom Facility Misuse and Public Health Hazard Mr. Eng and Members of the Board of Directors – Public Engagement, This statement documents a persistent public health and safety hazard at Back Bay Station that has remained unresolved for over one year. A consistent daily pattern has been observed between approximately 5:30–7:30 AM and 9:00–11:00 PM. During these periods, the same individual shelters within the station for approximately four hours per day, occupying the commuter rail lobby and the women’s restroom. One of the ADA-accessible stalls is routinely occupied, effectively blocking public access. During these intervals, conditions regularly include water accumulation on restroom floors, unsanitary use of facilities, and the presence of a tied plastic bag containing apparent waste material. These conditions present clear biohazards, create slip-and-fall risks, and restrict access to ADA-compliant facilities. Periodic vocal disturbances are also observed, disrupting the station environment and causing discomfort among riders. These issues have been reported by MBTA inspection personnel to the Operations Control Center (OCC), resulting in Transit Police responses. Multiple additional requests for police response have also been made. Despite this, the condition persists twice daily. Immediate and sustained intervention is required, including active monitoring, consistent enforcement of station policies, and appropriate outreach and coordination. This matter represents an ongoing public health and safety risk and a preventable source of liability that requires prioritized attention
