FORMAL NOTICE OF NON-COMPLIANCE AND DEMAND FOR CASE REOPENINGTO:Commissioner Nick Gove, Boston Transportation Department (nick.gove@boston.gov)Cabinet Leadership, Boston Public Works Department (PWD)City of Boston Executive LeadershipDATE: June 22, 2026SUBJECT: Emergency Demand to Reopen Case and Remediate Severe ADA Violations at Columbia Road Crosswalk (Stoughton St / Dudley St)1. Official Rejection of Case ClosureThe Uphams Corner community formally rejects the closure of this public safety case. The justification provided by the City of Boston for closing this file is entirely unacceptable. This document serves as our final administrative notice: the City of Boston must reopen this case immediately.Failure to do so will result in the immediate filing of formal, systemic complaints with the Massachusetts Department of Transportation (MassDOT), the Federal Highway Administration (FHWA), and relevant state and federal regulatory governing bodies.2. Statement of Emergency Hazards & ADA ViolationsThe City of Boston is currently operating in direct violation of federal law. The pedestrian crosswalk located on Columbia Road at Stoughton Street and Dudley Street (adjacent to Santander Bank) constitutes an immediate physical threat to public safety.Specifically, the crosswalk violates the Americans with Disabilities Act (ADA) of 1990 Guidelines for Crosswalk Hazards and Impediments due to:Severe Vertical Changes: Deep, dangerous pavement indentations.Hazardous Openings: Displaced, protruding gratings and structural shifts. These defects create severe tripping hazards for all pedestrians and present an impassable, dangerous barrier for physically and visually impaired residents.3. Demand for Immediate ActionThe systemic neglect and repeated dismissal of emergency infrastructure needs in the Black and Brown neighborhoods of Uphams Corner will no longer be tolerated. We demand equitable enforcement of public safety standards. The Uphams Corner community, including its residents, merchants, and visitors, demands the following binding timeline:Immediate (Within 48 Hours): Reopen the municipal service case and deploy emergency temporary repairs to mitigate the immediate tripping hazards.Expedited Schedule: Provide a transparent, written timeline for the permanent engineering replacement of this hazardous crosswalk. The City of Boston is now on notice. We expect immediate confirmation that this case has been reopened and prioritized.
